TUPE, or not TUPE?

All business owners or prospective business owners must consider the role TUPE will play when transferring a business or changing a service provision.

Transfer of Undertakings (Protection of Employment) regulations (TUPE) applies to employees of businesses in the UK.

When there is a change of business ownership TUPE usually applies. When TUPE applies:

  • the employees’ jobs transfer over to the new company;
  • their employment terms and conditions transfer;
  • continuity of employment is maintained.

There are 2 types of transfer protected under TUPE regulations:

  • business transfers;
  • service provision changes.
