In very general terms, you are likely to need the help of a Notary Public if you have to deal with documents to be used outside England and Wales.

The most frequent examples of circumstances in which you will need the help of a Notary Public are:-

  • Buying or selling property abroad
  • Dealing with assets abroad after someone’s death
  • Providing certified copies of personal documents to a foreign Government or Agency
  • Getting married abroad
  • Signing a Certificate that you are still alive if you are receiving a pension from a foreign Government or Agency

There are three very important things which you need to remember.

  • The first is that the documents which you sign take effect in accordance with the law of the relevant foreign Country.  If you are buying a property in Spain, the legal process is that of Spanish law.  As a result, if you have any questions or need any advice, you must ask a foreign lawyer.
  • The second is that documents to be used abroad have to comply with the legal requirements of the Country in which they are to be used.  It is the responsibility of the foreign lawyers to prepare the documents and to give details of any particular procedure which has to be followed when they are signed.
  • The third is that it can save a lot of time if you send me the document before you come to see me.  I can then check whether I have any questions about the document or the procedure for signing it.
