Powers of Attorney

If your health fails or your mind blows, it is probable that you will no longer be able to organise or manage your own finances.  None of us like the idea of this – but it does happen.  If it does, no-one can make decisions for you unless they first have the legal authority for that.

If health disaster strikes, someone – usually a family member – has to apply to the Court of Protection to be appointed to manage your financial affairs as your Deputy; the downside is that the Court application takes time and is expensive. However there is an alternative.

A Lasting Power of Attorney lets you give to people of your choice legal authority to take over from you if you cannot manage things for yourself; the important point is that you are the person choosing those whom you trust to do this for you.

A Lasting Power of Attorney is a fairly straightforward document, even if it is time consuming to set up.  Keep it to one side until the day comes – if it ever does – when it is needed. Your attorney can start managing things for you straight away.

The Lasting Power of Attorney is all about precaution against health failure; it is not a prophecy that a day will come when you cannot manage things for yourself.
