The Equality Act 2010 brings together various older bits of anti-discrimination legislation. It incorporates the Race Relations Act 1976 and the Disability Discrimination Act 1995. It makes it illegal to discriminate against a person’s protected characteristics.

Protected characteristics make for nine different types of discrimination. They are:

  • Age Discrimination - it would be illegal to not hire you because you’re close to retirement age or to sack you for the same reason.
  • Disability Discrimination - if you have a physical or mental impairment. As     long as it doesn’t affect your ability to carry out the role, employers can’t use this as a reason not to hire or promote you.
  • Gender Reassignment Discrimination- if you transition, or have done so, from male to female or vice versa, employers aren’t allowed change their treatment of you.
  • Marriage and Civil Partnership Discrimination - employers aren’t allowed to let your marital status affect their decision making. They may second guess and assume certain positions are better for single people, but this is unlawful.
  • Pregnancy and Maternity Discrimination - if you’re pregnant or on maternity leave, employers aren’t allowed to treat you differently or use it as a reason for dismissal.
  • Racial  Discrimination - your employer is forbidden from using your ethnicity, nationality or skin colour as a reason for dismissal, different treatment or overlooking for promotion.
  • Religious Discrimination - employers are enforced by law to overlook religion in the treatment, hiring and dismissal of employees.
  • Sex Discrimination - your employer isn’t allowed to treat you differently based on whether you’re a man or a woman.
  • Sexuality Discrimination - employers are required by law to not allow whether you’re heterosexual, homosexual, bisexual or any other sexuality to influence their treatment of you.

If you’re being discriminated against in the workplace you'll feel isolated. It doesn’t matter whether it’s your employer or colleagues. There’s nothing worse than being singled out for something you have no control over.

Discrimination isn’t as simple as insults or attacks because of a difference. It can come in the following types:

  • Direct  Discrimination - this is when you’re discriminated against because of your protected characteristic (e.g race).
  • Indirect Discrimination - this is when a policy, practice or procedure at a place of work automatically puts you at a disadvantage if you have a certain characteristic. (E.g expecting unmarried employees to work later hours because they don’t have families.)
  • Discrimination by Perception - this is when you’re discriminated against for a     characteristic you’re believed to hold, but actually don’t. (E.g being excluded from after work drinks by homophobic colleagues on the belief that you’re gay.)
  • Discrimination by Association - this is when employers or colleagues treat you     differently because of the protected characteristic of a person you spend time with. (E.g receiving racial abuse at work for having a partner of a different ethnicity.)

As you’ll be able to tell, Discrimination in the workplace is a complex matter. It’s not always clear whether you’re a victim of discrimination or if there are other factors at play. Similarly, if you’re unaware of certain things you might not know you're being discriminatory.
