Compensation for unfair dismissal is made up of a ‘basic award’ and a ‘compensatory award’. The basic award depends on your age and years of service and can be up to £14,370. Compensatory awards can be up to £78,962. So maximum compensation for unfair dismissal is £93,332. Imagine how that would damage your company. Not to mention gaining a reputation as a business that mistreats employees.

Depending on the grounds for dismissal, the compensation amount could be even higher. Discrimination, whistleblowing, and health and safety as reasons for dismissal have no compensation limit. All the more reason for you, as an employer, to be cautious.

Even if you think you’ve dismissed staff fairly, they could still claim unfair dismissal. They could argue that:

  • You dismissed them for a different reason than the one you stated
  • Your reason was still unfair
  • You didn’t act in a reasonable way - e.g failing to give them enough warning

As well as dismissal being contestable, there are automatically unfair reasons for dismissal. These include:

  • Dismissal for pregnancy and relating to maternity rights
  • Acting as an employee or trade union representative

In some cases, negotiation can be used to settle unfair dismissal disputes. However, you may be unable to come to a settlement. If so, Employment Tribunal is the next step.
